Welcome to CarePerch. By accessing or using our mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Scope of Service

CarePerch is a personal wellness tool designed for family caregivers to track medications for their loved ones. The App is provided for personal, non-commercial use only.

2. User Obligations

You agree to:

• Provide accurate and current information
• Maintain the security of your account credentials
• Use the App only for lawful purposes
• Not attempt to reverse engineer, hack, or compromise the App's security
• Not use the App to violate any applicable laws or regulations

3. Medical Disclaimer

CarePerch is NOT a medical device and is NOT a substitute for professional medical advice, diagnosis, or treatment.

Always consult your doctor or pharmacist regarding:

• Starting or stopping medications
• Potential drug interactions
• Changes to your medication regimen
• Any medical emergencies

Drug interaction warnings provided by the App are based on a curated subset of publicly available data and are NOT comprehensive. If you experience a medical emergency, call 911 immediately.

4. Privacy & Data Protection

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in our Privacy Policy.

5. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are the exclusive property of CarePerch or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the App without our express written permission.

6. User Content

You retain ownership of any data you input into the App ("User Content"). By using the App, you grant us a limited license to process, store, and display your User Content solely for the purpose of providing the App's services to you.

You are responsible for the accuracy and legality of your User Content. We reserve the right to remove any User Content that violates these Terms or applicable law.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAREPERCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

This includes, but is not limited to, damages arising from:

• Reliance on medication reminders or drug interaction warnings
• Errors or inaccuracies in the App
• Unauthorized access to your data
• Interruption or cessation of the App's services

8. Indemnification

You agree to indemnify, defend, and hold harmless CarePerch, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party

9. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease.

You may terminate your account at any time by contacting us at support@careperch.com or through the App's Settings.

10. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will notify you via email or through a prominent notice in the App. Your continued use of the App after such changes constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

12. Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial or to participate in a class action.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and CarePerch regarding your use of the App.
